Korea Zinc Files Complaint with Financial Supervisory Service Against MBK Partners for Alleged NDA Breach and Insider Information Misuse

[Alpha Biz= Reporter Kim Jisun] Korea Zinc has filed a formal complaint with the Financial Supervisory Service (FSS), alleging that MBK Partners violated a Non-Disclosure Agreement (NDA) and misused non-public information. The company claims that MBK Partners obtained a 112-page confidential consulting document detailing Korea Zinc’s Troika Drive strategy and corporate value forecasts, and potentially used it inappropriately to disrupt market stability and trading order.


On December 15, Korea Zinc announced that it had submitted a complaint to the FSS against MBK Chairman Kim Byung-ju, MBK Partners, MBK Partners Special Situations Co., Ltd., and MBK Partners HK, along with other key individuals associated with the firm.

The complaint lists key personnel from MBK Partners as unidentified individuals, explaining that anyone involved in deciding, directing, or executing the alleged misconduct under MBK Partners’ direction should be included in the investigation.

Korea Zinc asserts that MBK Partners may have utilized the confidential materials to unfairly gain an advantage, potentially impacting market order. The company is urging the FSS to conduct a thorough investigation to determine the extent of any violations and hold those responsible accountable.

The case is expected to draw significant attention, as the FSS's findings could escalate the dispute into a larger legal battle between Korea Zinc and MBK Partners.
