[Alpha Biz= Kim Jisun] Hanwha Qcells has clarified that its U.S. subsidiary briefly filed a lawsuit against the U.S. government seeking a refund of reciprocal tariffs, but immediately moved to withdraw the case, citing an administrative error by its external law firm.
According to Hanwha on December 22, the lawsuit was mistakenly filed on December 19 (local time) with the U.S. Court of International Trade against U.S. Customs and Border Protection. The filing challenged tariffs imposed under the International Emergency Economic Powers Act (IEEPA).
Hanwha emphasized that it had never internally reviewed or approved litigation against the U.S. government. The company said the filing occurred when a law firm inadvertently submitted draft materials that included a litigation option under review.
Hanwha Qcells said it recognized the error shortly after the filing and immediately initiated withdrawal procedures, adding that no legal consequences are expected as the case is being promptly dismissed.
The incident comes amid a growing number of tariff-related lawsuits in the U.S., following recent court rulings questioning the legality of tariffs imposed under IEEPA.
